Alleged defamation: Oyo political leader Rotimi Ajanaku sues Yinka Ayefele's Fresh FM

Otunba Rotimi Ajanaku, a prominent businessman, philanthropist, and political leader in Oyo State, has filed a N100 million defamation lawsuit against Fresh FM Nigeria, owned by gospel musician Yinka Ayefele.

He accused the station of airing false allegations that have severely damaged his reputation.

Through his lawyers, Obisesan & Co. (The Law Union), Ajanaku demanded that Fresh FM issue a public apology, cease any further defamatory reports, and pay N100 million in damages.

The petition was served on the station’s CEO/Managing Director at Ayefele Music House, Challenge, Ibadan.

The suit stems from a broadcast on August 13, 2025, in which Fresh FM’s correspondent, Adeola Bankole, claimed that Ajanaku’s Dino Hotel project in Imalefalafia Community, Oke-Ado, obstructed public pathways, caused flooding, and violated part of the late Pa Obafemi Awolowo’s master plan.

Ajanaku maintains that the land was lawfully acquired, all necessary approvals were obtained, and construction proceeded under proper supervision. His lawyers argued that Fresh FM violated his right to fair hearing and the legal principle of audi alteram partem (“hear the other side”), turning the broadcast into “an instrument of injustice.”

Citing Section 375 of the Nigerian Criminal Code Act and relevant court rulings, the petition warned the station of potential civil and criminal liability, emphasizing that libel damages are presumed without proof of actual loss.

Fresh FM has been given seven days to comply, or Ajanaku’s legal team will pursue court action and a formal complaint with the Nigerian Broadcasting Commission (NBC).

The petition described the development as “highly unfortunate” and stressed that Ajanaku is “a man of impeccable character, widely respected by the public.”

As of press time, Fresh FM had not responded to the claims.
